Terms of Service

1 Purpose

These Terms of Service (hereinafter “Terms”) define the terms and conditions of use of the FAKE AI OR REAL service (hereinafter “the Service”), published by GEKKODE, an independent developer based in France.

The Service includes the "FAKE AI OR REAL" Chrome browser extension, the associated server infrastructure (API), and the website accessible at fakeaiorreal.gekkode.com.

2 Acceptance of terms

By installing the extension, creating an account, or using the Service in any way, you agree to be bound by these Terms. If you do not accept these terms, please do not use the Service.

GEKKODE reserves the right to modify these Terms at any time. Users will be notified of any substantial changes. Continued use of the Service after notification constitutes acceptance of the new terms.

3 Service description

FAKE AI OR REAL is a Chrome extension that detects videos and images potentially generated by artificial intelligence (AI) or constituting deepfakes. The Service works as follows:

• The extension captures visual samples from the content displayed in the user’s browser.
• These samples are securely transmitted (HTTPS) to our analysis server.
• The server processes them through our proprietary detection pipeline and returns a confidence score.
• The result is displayed as a score and verdict: Authentic, Suspect, or AI-Generated.

Supported platforms depend on the subscribed plan (YouTube, TikTok, and others depending on the plan).

4 Accounts and registration

Upon first use of the extension, an anonymous identification token is automatically generated and stored in your browser via chrome.storage.sync. This token is synchronized across your devices through your Google Chrome account.

No personal information is required to use the free plan. For paid plans, an email address is collected during the payment process via Stripe, solely for account management and access recovery purposes.

You are responsible for the security of your authentication token. In case of loss (reinstallation, device change), paid users can recover their account via their email address.

5 Plans and pricing

The Service is offered in three tiers:

The indicated quotas are daily limits. An absolute cap of 100 analyses per day applies to the Pro plan (50 for other plans) to prevent automated abuse.

GEKKODE reserves the right to modify prices. Any price change will be communicated to users at least 30 days before it takes effect. Current subscriptions remain at the subscribed rate until the next renewal period.

6 Payments and billing

Payment provider. Payments are processed by Stripe, Inc., a secure and PCI-DSS certified payment provider. GEKKODE never stores your banking or credit card information.

Automatic renewal. Starter and Pro subscriptions are automatically renewed at the end of each billing period (monthly or annual), unless previously canceled by the user.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to your plan’s features until that date. No prorated refund is granted for the current period.

Right of withdrawal. In accordance with the French Consumer Code, you have a 14-day period from the date of subscription to exercise your right of withdrawal, unless you have used the Service during this period with your express consent to waive this right.

Payment failure. In the event of a payment failure upon renewal, GEKKODE may suspend access to paid features after a reasonable period and retry attempts.

Refunds. Outside of the 14-day right of withdrawal mentioned above, refunds are granted on a case-by-case basis, at GEKKODE’s discretion, only in the following situations:

• Major Service unavailability for more than 72 consecutive hours during a billing period.
• Technical error resulting in a duplicate charge.
• Substantial defect in the Service making its use impossible.

For any refund request, contact contact@gekkode.com specifying your payment email address and the reason for the request. Requests are processed within 14 business days. Refunds are issued to the original payment method via Stripe.

7 Acceptable use

By using the Service, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms.
• Not attempt to circumvent the free plan limitations or analysis quotas.
• Not reverse-engineer, decompile, or disassemble the Service.
• Not use the Service in an automated manner (bots, scripts) without prior authorization.
• Not impersonate another user or create multiple accounts to bypass limits.
• Not use the Service to harass, defame, or infringe upon the rights of third parties.
• Not deliberately overload the Service infrastructure.

Any violation of these rules may result in the immediate suspension or termination of your access to the Service, without notice or refund.

8 Intellectual property

The entire Service — including the extension, source code, user interface, graphic elements, logo, the name “FAKE AI OR REAL”, and website content — is the exclusive property of GEKKODE and is protected by French and international intellectual property laws.

Installing the extension grants you a personal, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

Any reproduction, distribution, modification, or use of the Service outside the authorized scope is strictly prohibited.

9 Limitation of liability

Indicative results. The scores and verdicts provided by the Service are algorithmic estimates for informational purposes only. They do not constitute a certification, expert opinion, or formal proof of the authenticity or artificial origin of any content.

No guarantee of accuracy. GEKKODE does not guarantee the accuracy, completeness, or reliability of analysis results. AI-generated content detection is a constantly evolving field; false positives and false negatives are possible.

Use of results. You are solely responsible for decisions made based on results provided by the Service. GEKKODE disclaims all liability for the direct or indirect consequences of using these results.

Third-party services. The Service relies on third-party services for detection and payment processing. GEKKODE cannot be held responsible for failures, interruptions, or modifications of these third-party services.

Limitation. To the extent permitted by French law, GEKKODE’s total liability under these Terms shall not exceed the total amount paid by the user during the 12 months preceding the event giving rise to the claim.

10 Service availability

GEKKODE strives to ensure the availability of the Service 24 hours a day, 7 days a week. However, the Service may be temporarily unavailable due to:

• Maintenance operations (scheduled or emergency).
• Updates to the extension or server infrastructure.
• Technical failures beyond our control (network outage, third-party service unavailability).
• Force majeure events.

GEKKODE cannot be held responsible for service interruptions and does not guarantee any level of availability (SLA).

11 Modification of terms

GEKKODE reserves the right to modify these Terms at any time. In the event of a substantial modification, users will be notified via a notification in the extension or by email (for paid users) at least 15 days before the new terms take effect.

The last updated date is indicated at the top of this document. Continued use of the Service after the modifications take effect constitutes acceptance of the new Terms.

12 Termination

By the user. You may stop using the Service at any time by uninstalling the extension. For paid plans, you must also cancel your subscription via the management portal accessible from the extension.

By GEKKODE. GEKKODE may suspend or terminate your access to the Service, with or without notice, in the event of:

• Violation of these Terms or the acceptable use rules.
• Fraudulent or suspicious activity detected on your account.
• Non-payment of the subscription after follow-up attempts.
• Legitimate decision to discontinue the Service (in which case, reasonable notice will be provided).

In the event of termination for violation of these Terms, no refund will be granted.

Account deletion. You may request the permanent deletion of your account and all associated data directly from the extension (Settings > My account > Delete my account). This action is irreversible and results in the immediate cancellation of any active subscription.

Data retention after termination. In the absence of a deletion request, your account data is retained for a maximum period of 3 years after your last activity, in accordance with CNIL recommendations. A notification email is sent to you 30 days before automatic deletion. For more details, see our Privacy Policy.

13 Governing law

These Terms are governed by French law.

In the event of a dispute relating to the interpretation or performance of these Terms, the parties agree to seek an amicable resolution before taking any legal action.

In accordance with Articles L.611-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably, the consumer may use the mediation service free of charge. Failing amicable resolution, the competent courts shall be those of the defendant’s place of residence, in accordance with ordinary rules of jurisdiction.
